TERMS AND CONDITIONS
These Terms and Conditions are an integral part of The College Butler Online Order Form and Customer Agreement to which these Terms and Conditions are attached (collectively, the “Agreement”). In this Agreement, The College Butler, LLC. is referred to as “TCB” or the “Company”, and the customer is referred to as “you” or the “Customer”. This Agreement is the complete and full understanding between you and TCB regarding the Services you have ordered pursuant to the Agreement. Any other terms, conditions, warranties, guarantees, undertakings, understandings or representations whether express or implied by statute (insofar as such statute permits), common law or otherwise or arising from conduct or a previous course of dealing or trade custom or usage are hereby excluded from this Agreement. No variation of this Agreement is binding on the Company unless agreed to in writing and signed by an authorized officer of the Company. To the extent of any conflict between the terms of the Order Form and Customer Agreement and these Terms and Conditions, these Terms and Conditions shall be controlling.
TCB Storage Services
TCB provides the following services: (i) delivery or shipping of packing materials (i.e., boxes and tape) to Customer at predetermined location; (ii) pick up of Customer’s possessions at Customer’s residence on the scheduled pickup date (the “Scheduled Pickup Date”) within the Pickup Period; (iii) transportation of items to a suitable storage location as chosen solely by TCB; and (iv) delivery of the Customer’s possessions to Customer’s residence at the completion of the storage term on the scheduled drop-off date (the “Scheduled Drop – off Date”) within the Acceptable Drop – off Period as described below, (collectively, the “Services”).
At Customer’s request, TCB will deliver reasonable packing materials to your residence for packing your possessions. TCB Boxes are provided free of charge to customers who contract to use our storage services. Boxes supplied for personal use other reasons will be supplied at a charge of $5 per box requested. Our Go Green Value Bins are provided to students for a rental charge of $5 per semester plus applicable storage charges. Go Green Bins must be returned on one of our specified collection dates. If a customer fails to return a bin within a reasonable amount of time (2 weeks after delivery), the bin will be deemed "uncollectible" and the customer will be charged $25 per uncollectible bin.
Boxes not supplied by TCB used by the Customer for storage will be charged based upon the dimensions of TCB boxes, using the largest dimension of the nonconforming box to determine its comparable size to determine the applicable charge. Heavy boxes (boxes weighing over 50 pounds) will be charged a 50% surcharge at the sole discretion of TCB.
In the event a customer receives packing materials and wishes to cancel the service, the customer agrees to pay TCB $5 per box collected and $2 per roll of tape collected, in addition to a $50 cancellation charge.
Pickups will typically begin the weekend prior to the first day of final exams and end on the last day of the weekend following finals for a given school unless otherwise noted on the school's scheduling form. A pickup falling outside of the Pickup Period may be subject to TCB’s prevailing fee for pickups outside of the Pick – up Period, as such additional fee is set forth on the TCB Website (Out of Window).
You are responsible for choosing an AM or PM pickup time as stated on the form (the “Pickup Window”) for TCB to pick up your boxes during the Pickup Period. TCB will provide you with a smaller 1-2 hour window via email within 24-48 hours of the "Pickup Date." TCB will send a representative to pickup the boxes from your residence on the Scheduled Pickup Date. TCB cannot and does not guarantee that pickup of the boxes will occur at a specified time during the Pickup Window. The TCB representative will verify your identity by asking you to produce an acceptable form of picture identification, and then transport the boxes containing your personal belongings to a storage facility.
In the event that Customer is unable to be present during the Pickup Window or if the pickup location changes, the Customer must provide notice to TCB 24 hours prior to the Scheduled Pickup Date. Failure to provide timely notice will result in a charge to Customer of TCB’s prevailing fee for pickups outside of the Scheduled Pickup Date, as such additional fee is set forth on the TCB Website Pick Up fee ($50 - $100). The customer can avoid the fee by allowing a friend to be present for pickup. The customer must provide TCB with the friend's information (full name, phone number, email address) at a reasonable time before pickup.
The standard option for pickup service is "Main Lobby" which means that our crew member(s) will pick the items up from just outside of the main lobby of your apartment or residence. TCB also offers "in-room service" pickup option. If the Customer selects "in-room pickup", our crew members will pick the items up from the Customer's room or dorm. The Customer can select "in-room pickup" for an additional $25-$50 fee. The customer or customer's trusted roommate/friend must be available to let our crew member(s) into the dorm or residence. In many cases, the Customer will need to present valid ID and sign our crew member(s) into the Pickup Residence. The crew member(s) will make every effort to contact the customer using the phone number(s) provided.
If a Customer’s items are improperly packed and the Customer would still like to store those items, TCB will pack or re-pack the Customer’s items, and Customer shall pay an additional fee at TCB’s prevailing service rate of $30 per item.
Additional fees and charges will be assessed if the Customer does not live within a five (5) mile radius of the main campus at the school. TCB will assess such fees and charges based on the distance from the main campus and the time it takes to travel to such location, according to TCB’s prevailing standard rates for delivery and travel, as such standard rates are set forth on the TCB Website. In any event and in addition to any other applicable fees and charges, a minimum fee of $100.00 will be charged for any pick – up or drop-off that is not within a five (5) mile radius of the school’s main campus.
If the customer live off campus or in a location that required paid parking or access to a loading dock, the customer is responsible for any parking charges that may apply. If the customer is located off campus in Center City Philadelphia (any area east of the Schuylkill River from 30th Street to N Columbus Blvd) the customer agrees to pay an additional $100.00 charge.
TCB will store your belongings at a storage location selected by TCB. Subject to the terms set forth herein, TCB will store the Customer’s belongings between the Pickup Date and the Drop-off Date. Customer will be charged for storage services during a storage period commencing on the first day of final exams at the school, through the first day of scheduled classes in the following school year (the “Storage Period”). The total charges for Storage services are based on a per item fee multiplied by a semester rent as listed on www.thecollegebutler.com. A "semester" is approximately a 3-4 month period (i.e. summer, fall/winter, winter/spring). Any items stored in the midst of one semester will be charged a pro-rated monthly rate per item for any additional time stored. Please refer to the detail on our pricing page of our website. You will receive an invoice for the full storage bill within 72 hours after pickup. Once the invoice is sent, the customer must pay the invoice within 10 days to avoid any late fees which are described in the Additional Fees section of The College Butler website.
You acknowledge that you have inspected each box prior to your scheduled "Pickup Date" and each one is in good condition and suitable for the intended purpose of storing your goods and personal belongings. TCB is not responsible for any damage caused to a box or its contents as a result of your negligence or willful misconduct or that of your agents or representatives. You will make no alternations or additions to a box without TCB’s written permission.
You represent that you are the lawful owner of the items being stored or are otherwise authorized to execute this Agreement on behalf of the lawful owner. Items being stored must be packaged by Customer suitably for storage purposes, and must not be prone to fire, leakage, moisture, spoilage, contamination or explosion, or be deemed hazardous materials under any applicable laws. The Customer undertakes not to store any items in violation of any applicable laws. Under no circumstances should a student store perishable or nonperishable food and/or beverage products. If a box or standalone item is found to contain any sort of edible food or beverage, the entire storage order will be disqualified from the insurance program and the customer may also be held liable for damages to surrounding items.
Since the pricing list on the pricing page of our website is not exhaustive of all items that we store, generally, box, bin and luggage-type items greater than 4 cubic feet (the size of a TCB Value Box) will qualify as a "Large" item. Any similar item greater than 5 cubic feet (think a very large box) will qualify as an "Extra Large" item. Items that are 4 cubic feet or less will be deemed a "Standard" item unless we determine that the size or weight would qualify the item to be a "Small" item. Some items are slotted in a particular category due to special care that needs to be taken to handle or store. The standard drop-off time period will include the day before the first day of class of the fall semester at a given school and a period of time prior to the first day of class for the fall semester, the “Standard Delivery Dates”. The "Standard Delivery Dates" are listed on the registration form for each school respectively.
An early drop-off may be scheduled during the time before the Standard Delivery Dates. A late drop – off may be scheduled during the weekend after the standard Drop-off Period, which may either be a Saturday or Sunday, subject to the discretion of TCB. All of the foregoing time periods are referred to as the “Acceptable Drop – off Period”. Any drop – off falling outside of the Acceptable Drop – off Period may be subject to an additional fee, as such additional fee is set forth on the TCB Website. (Out of Window Fee).
You are responsible for scheduling a Delivery Date (the “Delivery Date”) for TCB to drop – off your boxes during the Acceptable Delivery Period. TCB cannot and does not guarantee that delivery of the boxes will occur at a specified time during the Delivery Date. TCB will make one (1) attempt to deliver the Customer’s items to Customer’s residence on the Scheduled Delivery Date. If a delivery attempt is unsuccessful, the Customer is subject to TCB’s prevailing Missed Appointment Fee ($50), as such additional fee is set forth on the TCB Website. You are required to submit your delivery details within 2 weeks of your expected return date. The College Butler utilizes these details when completing your storage delivery. The College Butler is not responsible for any delivery error that would potentially occur if the delivery details are inaccurate (i.e. incorrect delivery residence and/or room number, wrong delivery date, inaccurate email address, etc.). If a delivery error occurs due to inaccurate delivery details, the following additional charges would apply (listed, but not limited to): $50 missed delivery appointment fee; $100 order transfer fee (if transferring from one dorm to another), $75 rush-charge (for same day correction, available 9am-6pm), additional in-room service charges (if applicable). Lastly, you confirm that in the event of a delivery error, The College Butler no longer assumes any liability or responsibility for damage or loss to your storage items that may result due to inaccurate delivery details that you provide.
The standard option for delivery service is "Main Entrance" which means that our crew member(s) will deliver the items to a location just outside of the main lobby of your apartment or residence. TCB also offers "in-room service" delivery option. If the Customer selects "in-room delivery", our crew members will deliver the items directly to the Customer's room or dorm. The Customer can select "in-room delivery" for an additional $25-$50 fee, depending on the school. These fees are listed on the pricing page of our website. The customer or customer's trusted roommate/friend must be available to let our crew member(s) into the dorm or residence. In many cases, the Customer will need to present valid ID and sign our crew member(s) into the Delivery Residence. The crew member(s) will make every effort to contact the customer using the phone number(s) provided.
The Customer may request that TCB deliver their items to an authorized third party or that TCB leave Customer’s items outside of their residence, provided that the Customer has provided the name and location of the third party authorized to accept delivery of the Customer’s items, and the Customer executes such additional documentation as required by TCB. The authorized third party must present photo identification and sign a release and waiver at the time of delivery. TCB is not responsible for any loss or damages to the Customer’s items resulting from a delivery to an authorized third party. If you college or university does not permit us to conduct contactless delivery services (i.e. The University of Pennsylvania, Haverford College, Drexel University, Saint Joseph's University), you confirm that you, or the approved delivery contact listed in the General Delivery Information section of this form will be present to meet our crew and receive your storage order. You understand that any delivery interruption caused by any of the following events will result in applicable inconvenience charges: Missed appointment: $50 (this includes same-day requests to update your delivery time slot to receive your items later in the day on your original selected delivery date); Reschedule appointment date or time window within 7 days of delivery: $50; Same-day appointment reschedule to a different date: $100; Switch to In-Room Service from Main Entrance Service within 48 hours of your appointment: $50 plus the applicable in-room service charge.
In the event that a Customer has stored their items with TCB and would like their items shipped to them instead of being dropped off in accordance with TCB’s drop – off policy herein, TCB will ship the Customer’s items to the Customer at the sole expense of the Customer in addition to the TCB standard shipping fee as set forth on the TCB website. TCB is not responsible for any damage or loss that results from the shipping of the Customer’s items.
1) Pickup of mattress or box spring: Every mattress or box spring must be protected with a plastic mattress cover. We provide mattress covers at a charge of $10 per cover.
2) Large bed frame assembly: We will disassemble and reassemble a large bed frame (any frame that is not a standard metal frame) for a $50 charge. If the Customer does not want to be charged for this service, the frame must be fully disassembled by the scheduled pickup time.
3) TV Protection: If the customer does not store TV in its original box, the TV must be protected with a TV box. We will protect the Customer's TV by providing a TV box an additional $20 -$30 charge. All TVs and monitors must be protected with bubble wrap and in a TV box if not packed in exact original packaging.
Unless otherwise specified by written communication, drop-offs or pickups made outside of the Acceptable Delivery or pickup period may be subject to a $50 - $100 fee. See your school's pricing page for more information.
Additional fees and charges will be assessed if the Customer does not live in an on-campus residence at the school ($25 surcharge for a pickup or delivery). Additional fees apply for a student that lives more than 5 miles off-campus. TCB will assess such fees and charges based on the distance from the main campus and the time it takes to travel to such location, according to TCB’s prevailing standard rates for delivery and travel, as such standard rates are set forth on the TCB Website.
Off-Campus in Room Pickup and Delivery Fees for Moves Involving Furniture
Pickups and deliveries to off-campus residences involving large furniture items will be assessed additional pickup and or delivery charges based upon the floor and location. Since such moves are comparable to residential moves, they do not qualify for the standar in room pickup or delivery fee. For any off-campus pickup or delivery to a residence with a functioning elevator, the additional charge assessed will be no greater than $100. For any off-campus pickup or delivery without an elevator that involves walking up or down stairs, the additional charge assessed will be at the owner or manager's discretion following the below schedule:
Off-Campus pickup or delivery to first floor: Up to $50
Off-Campus pickup or delivery to second floor: Up to $100
Off-Campus pickup or delivery to third floor: Up to $200
Off-Campus pickup or delivery to fourth floor: Up to $300
Cancellations made less than 48 hours in advance will incur a $50 cancellation fee. Cancellations made after April 30th for summer storage pickups scheduled to occur in May of the calendar year will be assessed a $50 cancellation charge.
Our Right to Access Boxes
We may open any of your boxes without providing you with any prior notice in cases of emergency, which would include, but is not limited to, situations when, in our discretion, we need to: (i) make any repairs to the box or replace the box (however we are not obligated to repair or replace any boxes); (ii) locate and remove any property which appears to be seeping out of the box, or which appears to be emitting fumes or odors from the box, or which appears to be harming or endangering any other box or the property of any others; (iii) enforce the terms of this Agreement, including all our rights and remedies; (iv) open the box for security reasons generally; or (v) comply with any Court Order or applicable law or regulation. At all other times, we will provide you with reasonable notice prior to opening a box containing your belongings.
Your Right to Access Boxes
Provided your account with us is paid in full and you are not in default, you have the right to request delivery of your belongings to access your boxes and unboxed items for the purpose of inspecting, removing or adding stored goods, by contacting us at 800.203.8514. This is subject to TCB's prevailing Special Access Fee, as such additional fee is set forth on The College Butler Website. Please note that The College Butler requires a minimum of 48 hours prior notice in order to accommodate all such requests, and that you will be required to confirm your identity by means of an acceptable form of picture identification before our representatives will allow you access to your boxes.
The Customer agrees to pay the total cost of the Services provided by TCB as indicated on the Online Order Form/Pricing Page and Customer Agreement, plus applicable taxes, in accordance with the payment terms set forth on the Order Form/Pricing Page and Customer Agreement. Pricing can be found on the TCB Website, on the College Pricing Page. The minimum order charge for pickup and delivery storage service is is $150. $150 is the minimum storage order and this does not include additional fees such as in-room service or out of window charges. The Customer further agrees to pay any applicable fees and charges as specified in this Agreement or on the TCB Website, which fees and charges are subject to change at any time. Customer acknowledges that there shall be no refunds or credits provided to Customer, except as expressly set forth in this Agreement.
If the Customer pays by credit card, the Customer hereby authorizes TCB to charge Customer’s credit card in accordance to services provided to the Customer by TCB. In the event that a Customer’s payment cannot be authorized all charges associated with this Agreement must be paid in full in order to receive your items before the time of their delivery, plus any applicable late fees or other applicable fees and charges. The College Butler reserves the right to assess a reasonable fee (3%) for all payments using a credit or debit card. The customer is permitted to send payment via ACH (bank transfer) at no additional charge.
Payment is due within 10 days after the invoice is sent to the customer. If the customer fails to make the full payment within 10 (days), a late fee of $10 will be assessed to the unpaid invoice. Each additional day the invoice is past due will accrue an additional $1 in late charges, up to a maximum of $30 total. If Customer fails to pay any amount within sixty (60) days after it is due, the Customer’s possessions shall be deemed abandoned, and TCB shall have the right, but not the obligation, to take any reasonable action to dispose of any abandoned property, to recover any outstanding balance from the Customer. Customer shall be responsible for any costs incurred by TCB in connection with disposal of Customer’s property. TCB will have no obligation whatsoever to disclose information concerning action taken if any, and may still take necessary legal measures to obtain payment for Services provided from the Customer. TCB shall have no obligation to return any proceeds from the disposal of the Customer’s property, and any proceeds in excess of the outstanding balance owed to TCB under this Agreement shall be retained by TCB as liquidated damages.
Limitation on Liability
YOU HAVE FULL RESPONSIBILITY FOR, AND BEAR ALL RISK OF LOSS OR DAMAGE TO THE BOXES AND THEIR CONTENTS, AND FOR ANY DAMAGE CAUSED TO YOUR PROPERTY OR TO THE PROPERTY OF OTHERS BY THE BOXES OR BY THEIR CONTENTS WHILE THE BOXES REMAIN IN YOUR POSSESSION, INCLUDING WHILE THE BOXES ARE ON YOUR DRIVEWAY OR LOADING DOCK, OR IN ANY HALLWAY OR ANY OTHER COMMON AREA OF YOUR RESIDENCE.
SUBJECT TO THE SECTION ENTITLED INSURANCE, FOLLOWING PICK – UP OF YOUR BOXES FROM YOUR RESIDENCE UNTIL THE BOXES ARE DELIVERED TO YOU, TCB DOES NOT ASSUME ANY RISK FOR LOSS OR DAMAGE TO THE PERSONAL PROPERTY YOU HAVE PLACED IN THE BOXES FOR STORAGE, NO MATTER HOW THE LOSS OR DAMAGE MAY BE CAUSED, EXCEPT FOR LOSS OR DAMAGE CAUSED DIRECTLY BY OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, AND IN ANY EVENT TCB’S AGGREGATE MAXIMUM LIABILITY TO YOU SHALL NOT EXCEED THE FEES YOU PAID FOR THE SERVICES.
Customer shall defend, indemnify, and hold harmless TCB and its employees, agents and representatives from and against any and all claims, actions, demands, liabilities, damages, costs and expenses (including, without limitation, reasonable attorneys’ fees), arising out of, in connection with or related to the Services provided under this Agreement or any breach or default by Customer of any agreement, covenant, representation or warranty of Customer under this Agreement.
If the Customer is subject to any promotional discounts offered by TCB, the Customer must adhere to the following requirements to qualify:
1) Store for at least 1 semester or make a payment equivalent to one semester of storage.
2) Have no outstanding balance on his/her storage account from prior semesters.
3) Order must be at least $200
All items stored are automatically insured up to $100 provided that the items are packed appropriately and the items are eligible for storage*. Each "item" is defined as a full item stored as indicated on the billing statement. For example, a box would be considered an "item" for insurance purposes. The individual contents within the box are not considered "items". All electronics such as but not limited to TV's, Printers, Microwaves, Computers, Laptops, and Coffee Makers must be packed in full original packaging to be covered under our insurance policy. Cracked or damaged plastic bins are not covered under our insurance policy. Extremely fragile items such as mirrors and glass tables are not covered.**
Additional insurance for elegible items can be purchased through TCB at a cost of $5 per $100 dollars of insurance coverage per item per semester*. A Customer may purchase insurance up to a maximum $400 per item, and a total of $800 Aggregate per Customer.**
Any item additionally insured must be itemized in writing and submitted to TCB at the time the insurance is purchased. Please include this information in the Additional Comments section of the signup form. It is the sole responsibility of the Customer to obtain any additional insurance coverage. Except as expressly set forth above, all items stored in the storage facility are at the sole risk and expense of the Customer, who is responsible for arranging the appropriate insurance coverage.
*IKEA products are excluded from insurance coverage.
**Items that are ineligible for storage are excluded from insurance coverage (cash, jewelry, fine art, perishable items, illegal substances).
1. IKEA products are not covered under the The College Butler insurance program.
TCB does not insure against any damage to: intellectual property (e.g., computer files), heirlooms, extremely fragile items, improperly packed items, concealed damages, or minor damage due to normal handling (e.g., scratches, nicks, etc.), or damages due to natural disasters, damage occurring while not in the possession of TCB, or any damage occurring without evidence of physical damage to the exterior of the box. Overweight (i.e. in excess of 50 lbs) boxes, bins, luggages and trucks are not covered under the TCB insurance program. Under no circumstances should a student store perishable or nonperishable food and/or beverage products. If a box or standalone item is found to contain any sort of edible food or beverage, the entire storage order will be disqualified from the insurance program and the customer may also be held liable for damages to surrounding items.
Any damage to a customer’s belongings must be reported in writing to TCB within 72 hours of receiving a Delivery. Any claims made after 72 hours of a Delivery are not covered under the TCB Insurance program.
You are required to notify us immediately of any changes to your name, address, contact information, credit card, by contacting us at, 800.203.8514 or firstname.lastname@example.org The Customer warrants that any personal information that he or she provides to TCB is truthful, complete and accurate.
If, as a result of your failure to provide us with updated information, TCB is unable to process any fees or charges payable under this Agreement, or if TCB is unable to contact you in the event of an emergency, TCB may deem your property to have been abandoned, and dispose of any such property as provided herein.
The Customer hereby authorizes TCB to obtain consumer reports, and any other information it deems necessary, for the purpose of evaluating Customer’s application. Customer understands that such information may include, but is not limited to, credit history, civil and criminal information, records of arrest, rental history, employment/salary details, vehicle records, licensing records, and/or any other necessary information. Customer further understands that subsequent consumer reports may be obtained and used under this authorization in connection with an update, renewal, extension or collection with respect to or in connection with the Services for which this application was made.
